I have a feeling it's a common s.c 'cross-spider' (I know common names mean draghfyrhikilhooh but I cannot at the moment fetch the scientific name), but I just wanted to be sure. (As sure as can get from a pretty bad photo)

Larinioides sclopetarius a fav orb weaver of mine tho i dont see them every year where i live :(

This is the dark morph i see around here (http://www.esigge.ch/primaire/4-nature/02inver/aragnes-ed/argiopes/Araneus_sclopetarius1.jpg) this is lighter one like Yours (http://www.nicksspiders.com/nicksspiders/larinioidessc2.jpg)
